POPIA Notice

This notice sets out how BuyRent ("we", "us", "our") processes personal information in line with the Protection of Personal Information Act, 2013 (POPIA). It complements our Privacy Policy and explains, in POPIA terms, the basis on which we handle your information.

1. Responsible party

BuyRent is the "responsible party" for personal information processed through buyrent.co.za. You can reach us at sales@buyrent.co.za.

2. The information we process

We process personal information you give us when you register, list a property, send an enquiry, save favourites, or contact us. This may include your name, email address, mobile number, and the content of messages you send. We also process limited technical and usage information to keep the Service running.

3. Why we process it (purpose)

We process personal information to operate the marketplace: to manage accounts, publish listings, pass enquiries to the relevant agent, save your favourites, and maintain and secure the Service. We process it lawfully, for these specific purposes, and we do not use it in ways incompatible with them.

4. Consent and lawful basis

By using the Service and providing your information, you consent to us processing it for the purposes described in this notice and our Privacy Policy. Where the law allows, we may also process information to perform a contract with you, to comply with a legal obligation, or for our legitimate interests in running the platform. You may withdraw consent at any time, though this may limit your use of the Service.

5. Sharing and operators

Enquiries you submit are shared with the agent who posted the relevant listing. Agent profiles and listings are public. We use service providers ("operators" under POPIA), such as Google Firebase for hosting and storage, who process information only on our instructions and under a duty of confidentiality. We do not sell your personal information.

6. Security safeguards

We take reasonable technical and organisational measures to protect personal information against loss, damage, and unauthorised access, and we limit access to those who need it to run the Service. If a security compromise affecting your personal information occurs, we will act in accordance with POPIA, including notifying the Information Regulator and affected users where required.

7. Your rights as a data subject

Under POPIA you have the right to:

  • Be told what personal information we hold about you and request a copy.
  • Request correction or deletion of inaccurate, irrelevant, or excessive information.
  • Object, on reasonable grounds, to the processing of your information.
  • Withdraw consent where processing is based on consent.
  • Complain to the Information Regulator.

8. Retention

We keep personal information only for as long as necessary to fulfil the purposes in this notice, or as required by law. When you close your account we delete or anonymise your information, subject to any records we are legally required to keep.

9. The Information Regulator

If you believe we have not handled your personal information lawfully, you may lodge a complaint with the Information Regulator of South Africa, the authority responsible for POPIA. We encourage you to contact us first so we can try to resolve your concern.
