Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BuyRent website at buyrent.co.za (the "Service"), operated by BuyRent ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What BuyRent is

BuyRent is an online marketplace that lets estate agents advertise residential and commercial properties for sale or to rent, and lets buyers and tenants browse those listings and contact the agents. We provide the platform; we are not a party to any sale, lease, or agreement between users and agents.

2. Accounts

To list properties or save favourites you must create an account. You agree to provide accurate information, keep your login details secure, and be responsible for activity under your account. You must be at least 18 years old to register. We may suspend or remove accounts that breach these Terms.

3. Listings and agent responsibilities

Agents who post listings are solely responsible for them and agree that:

• They have the right and authority to advertise each property.
• Listing details, prices, and photos are accurate and not misleading.
• They hold any licences or registrations required to operate as an estate agent in South Africa.
• Their content does not infringe anyone's rights or breach any law.

We review listings before they appear publicly and may decline, edit, or remove any listing at our discretion, but we do not guarantee the accuracy of any listing.

4. Acceptable use

You agree not to:

• Post false, fraudulent, or misleading content.
• Use the Service to harass, spam, or harm others.
• Scrape, copy, or harvest data or listings without permission.
• Interfere with or attempt to compromise the security of the Service.
• Use the Service for any unlawful purpose.

5. Enquiries and dealings between users

When you contact an agent, you do so directly. Any viewing, negotiation, offer, sale, or lease is strictly between you and the agent or property owner. We are not responsible for the conduct of any user or agent, or for the outcome of any dealing arranged through the Service. You should carry out your own due diligence before entering into any agreement.

6. Intellectual property

The BuyRent name, logo, and the design and software of the Service belong to us. Content you submit remains yours, but by posting it you grant us a licence to host and display it on the Service for the purpose of operating the platform.

7. Disclaimers

The Service is provided "as is" and "as available". We do not warrant that listings are accurate, that the Service will be uninterrupted or error-free, or that any property will be available. To the extent permitted by law, we exclude all implied warranties.

8. Limitation of liability

To the maximum extent permitted by law, BuyRent is not liable for any indirect, incidental, or consequential loss, or for any loss arising from your use of the Service, your dealings with agents or other users, or your reliance on any listing. Nothing in these Terms excludes liability that cannot lawfully be excluded.

9. Changes to the Service or Terms

We may change, suspend, or discontinue any part of the Service, and we may update these Terms from time to time. Material changes will be reflected by updating the date at the top of this page. Continued use after changes means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.
